The Ontario Court of Appeal last March overruled a lower court decision, determining provisions of the Criminal Code — the prohibition of keeping a brothel and living off the avails — were unconstitutional. The appeal court, however, ruled that the offence of communicating for the purposes of prostitution should remain on the books.
The court gave the federal government a year to address the laws, meaning the status quo remains in effect for the time being.
The federal government recently launched an appeal to the Supreme Court of Canada which will have final say on the issue.
Pugash said the decision to shelve john sweeps is based on the force’s reluctance to use “finite” resources to arrest people when so much “uncertainty” currently surrounds prostitution laws.
Pugash said investigations into illegal massage parlours, brothels and escort agencies will carry on as usual. (A police source inaccurately reported in Sunday’s Toronto Sun that police were no longer investigating escort agencies.)

Police officials confirmed Sunday that Toronto’s finest have placed john sweeps on hold following a court rulings that struck down several prostitution laws.
Most recently, the Ontario Court of Appeal ruled last March that the prohibition of keeping a brothel and living off the avails of prostitution are unconstitutional. The court determined, however, that communicating for the purposes of prostitution should remain illegal.
The matter is now headed to the Supreme Court of Canada for a final decision.
Fenn said his john school, which is offered as an alternative to a conviction for trying to buy sex, is currently counselling three men, but normally sees up to 60 at this time of year.
Students, he said, include those who have contracted sexually transmitted diseases, had their finances and marriages destroyed and have even been beaten by pimps.

BRAMPTON, Ont. — Just days after a teacher in Peel region was arrested for having sex with an underage prostitute, another faculty member from a local school faces allegations of engaging in inappropriate sexual behaviour with a 13-year-old girl.
Peel Regional Police say the latest accusation involves a grade school teacher who allegedly committed “several sexual offences against a former student.”
David Lang, 29, is charged with sexual interference, invitation to sexual touching and sexual assault.
The alleged victim was previously a student of Lang’s, police said Monday.
At the time of his arrest, the accused, who is to appear in Brampton court June 4, was teaching a Grade 8 class at Cheyne Middle School.

Just days after one Brampton school teacher was arrested for having sex with an underage prostitute, another teacher from that city now faces charges for alleged inappropriate sexual behaviour with a young teenage girl.
The latest accusation involves a grade school teacher who allegedly committed “several sexual offences against a former student,” Peel Regional Police said Monday.
David Lang, 29, a teacher from Cheyne Middle School in Brampton, is charged with sexual interference, invitation to sexual touching and sexual assault.
“The victim, a 13 year-old girl, was previously a student of Lang’s,” police said.

A middle-aged Brampton public school teacher is accused of having sexual relations with a 14-year-old hooker.
York Regional Police say the 46-year-old man was busted during an “ongoing” Drugs and Vice Unit investigation into juvenile prostitution and he’s facing several charges.
“Officers launched an investigation into an incident of juvenile prostitution occurring across the Greater Toronto Area where investigators believed a teenage female victim was being prostituted to men,” police said Friday of the probe that began last month.
“One suspect, a school teacher in the Brampton area, was identified and is alleged to have committed sexual acts with the 14-year-old female victim,” police said.
It’s believed the girl was forced into the sex trade and made to hand over her earnings to her pimp.
The alleged pimp has also been arrested, but his name was not released in order to protect the girl’s identity.
