Toronto Massage Parlors: Cops put john sweeps on hold

The Ontario Court of Appeal determined in March that provisions of the Criminal Code — the prohibition of keeping a brothel and living off the avails — were unconstitutional. The appeal court, however, ruled that the offence of communicating for the purposes of prostitution should remain on the books.
The court gave the federal government a year to address the laws, meaning the status quo remains in effect for the time being.
The federal government recently launched an appeal to the Supreme Court of Canada which will have final say on the issue.
Pugash said the decision to shelve John sweeps is based on the force’s reluctance to use “finite” resources to arrest people when so much “uncertainty” currently surrounds prostitution laws.
Pugash said investigations into illegal massage parlours, brothels and escort agencies will carry on as usual. (A police source inaccurately reported in Sunday’s Toronto Sun that police were no longer investigating escort agencies.)

Mammoliti claims brothels can curb the trafficking of women for the sex trade, clean up the shady massage and sex parlour industry, place health workers in clubs, force pimps out and make it safer for prostitutes and their customers.
“This is a very lucrative business and we can earn a lot of money as a city,” Mammoliti says. “We were the largest pimps in North America because of the amount of massage parlour permits issued.”

“It’s almost legal being an escort,” Amanda says. “We don’t have to pay taxes and have the best of both worlds.”
Toronto councillor Giorgio Mammoliti says the rules governing escort agencies and massage parlours are not being enforced due to the current legal challenge.
“This is still a major issue in most communities,” Mammoliti says. “We as municipalities cannot do anything to take enforcement action.”
Mammoliti estimates there are about 3,000 agencies, including massage parlours, bawdy houses, brothels and spas scattered throughout the city. Most are unregulated and anything goes, he says.

Chisvin’s supporters described him as a “exemplary judge who has empathy and intelligence” but demands that counsel come prepared.
Chisvin’s detractors said he was “impulsive and impatient. He has no time for Crowns and acquits when he shouldn’t.”
In 2007, he acquitted a massage parlour owner on bawdy house charges despite the club offering the undercover policeman a “happy ending” on his two trips.

TORONTO -
An unemployed Toronto man who fatally shot a Mississauga man in a senseless dispute at a north Etobicoke massage parlour was sentenced Wednesday to life imprisonment with no parole for 12 years.
“This case provides another sad example of the tragedy which occurs as a result of people arming themselves with handguns in this city,” said Justice Ian Nordheimer as he passed sentence on Augusto Charlery.
Three weeks ago, Charlery, 25, pleaded guilty to second-degree murder in the slaying of Johnny Youkhana outside the Golden Touch Spa on Milvan Dr. where patrons can buy either massages or sexual services. He had no prior convictions and has good prospects for rehabilitation, court heard.
Victim impact statements by his common-law spouse paid loving tributes to Youkhana, 36 and an auto body shop worker.

The crime was shocking: Three people were gunned down inside a massage parlour in Markham eight years ago.
They were bound, wrapped up and stuffed inside a red Ford Explorer owned by one of the victims.
The bodies were found inside the SUV, 12 kilometres north in the rear parking lot of Victoria Square United Church on Woodbine Ave. at Elgin Mills Rd. E.

Marvin the Martian @Prof Pye Chart: Imagine if the provincial government had control of the sex trade in this province, it could give all government workers a 10% discount or it could be a part of their benefits package. Much work needs to be done with this issue, but one issue of great concern is the illegal trade such as massage parlours where women are forced into this trade, they are part of the human smuggling trade. Maybe if the lawmakers can get this right, they’ll be able to take a chunk out of that horrendous practise.
