A Superior Court judge was asked Tuesday to dismiss a $30-million lawsuit launched against the federal government by a Toronto man who was infected with HIV by his stripper ex-wife.
Federal justice department lawyer Marina Stefanovic told Madam Justice Carol Brown that taxpayers should not be forced to pay for Percy Whiteman’s mistakes.
Whiteman, 36, is suing his ex, Suwalee “Ricky” Iamkhong, Immigration Canada, a government doctor and the Zanzibar tavern, alleging their negligence led to him contracting HIV.
“The federal government has no room in people’s bedrooms,” insisted Stefanovic.

Iamkhong, 42, a former exotic danger and prostitute in Hong Kong, entered Canada in 1995 on a four-month work permit and started working at the Zanzibar. She met and married Whiteman, a frequent customer at the strip bar, in 1997.

It is not reasonable for Canadian citizens to expect the government to be an “insurance” if they contract a disease after engaging in “risky” unprotected sex with an immigrant, argued Crown lawyer Marina Stefanovic in the Toronto court.

TORONTO – A $30-million lawsuit launched against the federal government, an immigration doctor and a popular Toronto strip club by a man who contracted HIV from his ex-wife nearly eight years ago should be dismissed because he waited too long to pursue legal action, the Ontario Superior Court heard Tuesday.
Percy Wilbert Whiteman, 36, claims all three parties were negligent in causing his infection because they did not take the necessary steps to find out that his former wife, Suwalee Iamkhong, was HIV-positive.
Whiteman alleges that immigration officials put him at risk by not testing Iamkhong, an exotic dancer from Thailand, for the human immunodeficiency virus when she immigrated to Canada in May 1995 on a special work visa.
The two met at the Zanzibar Tavern in downtown Toronto and were married from 1997 to 2004.
